# Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MyIntakes platform and any communications you receive from Intake Solutions of America, LLC ("ISA") acting as the authorized intake service provider for a law firm ("Client Firm"). By submitting an inquiry to a Client Firm, communicating with an ISA intake representative, or providing your contact information through any ISA-operated channel, you agree to these Terms.

## 1. Services

ISA operates the MyIntakes platform, which provides intake, scheduling, and client-communication services to Client Firms. ISA is not a law firm and does not provide legal advice. Any legal advice or representation is provided by the relevant Client Firm, subject to that firm's engagement agreement with you.

## 2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the services or to provide consent to receive communications.

## 3. SMS communications

By providing your mobile telephone number to a Client Firm or to an ISA intake representative, you consent to receive SMS messages from ISA, on behalf of the Client Firm, related to your inquiry, potential matter, or active representation.

- Program description: SMS messages may include intake follow-up, appointment scheduling, requests for documents or information, case status updates, and other communications related to your potential or active legal matter with the Client Firm.
- Message frequency: Variable, based on the status of your matter.
- Message and data rates: Standard message and data rates from your wireless carrier may apply.
- Opt-out: Reply STOP to any message at any time to stop receiving SMS messages. You will receive a confirmation message and no further messages will be sent, except as required by law or expressly requested by you.
- Help: Reply HELP to any message to receive support contact information.
- Supported carriers: Major U.S. wireless carriers. Wireless carriers are not liable for delayed or undelivered messages.
- Privacy: SMS opt-in and consent data is governed by our Privacy Policy at [https://myintakes.com/privacy](https://myintakes.com/privacy) and is not shared with third parties or affiliates for marketing or promotional purposes.

## 4. Your responsibilities

You agree to provide accurate information when interacting with ISA on behalf of a Client Firm, and to promptly notify the Client Firm if your contact information changes. You agree not to use the services for any unlawful purpose.

## 5. No attorney-client relationship through ISA

Communicating with an ISA intake representative does not, by itself, establish an attorney-client relationship between you and the Client Firm. Any attorney-client relationship arises only upon execution of a written engagement agreement with the Client Firm.

## 6. Confidentiality of communications

ISA handles consumer communications in a manner intended to support the Client Firm's professional and ethical obligations regarding prospective-client and client information. ISA personnel are subject to confidentiality obligations consistent with the Client Firm's policies.

## 7. Intellectual property

The MyIntakes platform, including its software, content, and branding, is the property of ISA or its licensors and is protected by applicable intellectual-property laws.

## 8. Disclaimers

The services are provided "as is" and "as available." ISA disclaims all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

## 9. Limitation of liability

To the maximum extent permitted by law, ISA's aggregate liability arising out of or relating to these Terms or the services will not exceed one hundred dollars ($100). ISA is not liable for indirect, incidental, consequential, special, or punitive damages.

## 10. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Guilford County, North Carolina.

## 11. Changes

ISA may update these Terms from time to time. The "Effective date" above reflects the most recent revision.
